NJL: The protection of female “virtue”, which is somehow very important, not to her (she is expendable), but to her spouse or her family. Either way it is only female behavior which is sufficiently outrageous to warrant legal homicide. And that is both biblical and koranic.

Re: Johnny Horton, I have 4 albums. One was the first record I ever played. Amazing that it isn’t scratched to death from picking up and putting down the needle. I now have CD’s “You keep a havin’ your fun, you lucky son of a gun on a honky tonk hard wood floor” Ol’ Slew foot. Honky Tonk Man, Got a Hole in My Pirough, Whispering Pines, The Mansion You Stole. His wife and widow was also Hank Williams widow.

No, Arcadia, they are not exactly the same. Heat of passion does not extend to family members and it usually family members who do an honor killing. Honor killings are about how the relationship makes the family look to outsiders, while heat of passion is because the offended spouse witnessed the dirty deed and couldn’t control his/her reaction.

This one does sound more like a murder-suicide at this point.

I got curious so here’s some stuff on in flagrante.

It’s not quite as bad as the more cold-blooded “honor” killing by other family members, but the underlying philosophy is exactly the same.

At common law, a man who killed his wife and her lover after seeing them in flagrante delicto –commiting adultery–could reduce the degree of his crime to manslaughter by claiming he acted in the heat of passion. Such mitigation acknowledged the killer’s passionate response to provocative behavior holding him blameworthy while professing some sympathy with the motive of the slayer. In four states proof that the defendant saw hi wife in flagrante delicto was grounds for acquittal. In Georgia, for example, acquitting such a defendant was analogized to self-defense. Wives, the courts opined, embodied delicacy and chastity and husbands were their protectors. The doctrine came into existence in the mid-1800s and was not repealed until the late twentieth century. Though treating in flagrante delicto as a complete defense arose as a judicial construction, courts defended the rule as embodying the intent of the legislature. It demonstrated a tension between the judges’ perceptions about their duty to interpret, not make, the law, and their desire to protect female virtue and Southern values.

Actually, there are cases where the defendant got off using the heat of passion even when he killed later on — his blood was still boiling, so to speak. Heat of passion is an old common law defense, and it still works.

I read a news article that the girl bought a gun Tuesday, shot McNair 4 times, then herself. It could be as simple as her realizing that he wasn’t planning to leave his wife.

Well, Obama is a no-nothing if he sides with the likes of Chavez. The rest of the quote is outrageous.
